These terms govern your use of the PixAlt website, software, and creative services. Please read them carefully before using our platform or engaging our services.

These Terms & Conditions ("Terms") form a binding agreement between you ("you", "the Client", or "the User") and PixAlt ("PixAlt", "we", "us", or "our"), located at Old No: 4, New No: 7, SBI Colony, Cantonment, Trichy – 620 001, Tamil Nadu, India. By accessing our website, subscribing to our software, or engaging our photography and creative services, you agree to be bound by these Terms.

1. Definitions

  • "Platform" refers to the PixAlt website and the PixAlt photography software, including all related tools and features.
  • "Services" refers to the subscription software plans and the creative services we provide, including photography, videography, album creation, photo editing, and website design.
  • "Subscription" refers to a paid plan that grants you access to the Platform for a recurring period.
  • "Content" refers to any images, videos, text, designs, or other material uploaded, created, or delivered through the Platform or Services.

2. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to use our Platform or Services. By using PixAlt, you confirm that the information you provide is accurate and that you have the authority to accept these Terms.

3. Accounts & Subscriptions

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • Subscription plans (currently offered from ₹1,000 to ₹2,850 per month, or as published on our Pricing page) are billed in advance on a recurring basis until cancelled.
  • Prices, features, and plan inclusions may change with prior notice. Continued use after a change constitutes acceptance of the revised terms.
  • You may cancel your Subscription at any time; cancellation stops future renewals but does not retroactively refund the current billing period except as set out in our Refund Policy.

4. Creative Services & Project Engagements

  • Photography, videography, editing, and design engagements are governed by the specific quotation, booking confirmation, or contract agreed between you and PixAlt, which forms part of these Terms.
  • A booking is confirmed only upon receipt of the agreed advance payment. Dates are reserved on a first-paid basis.
  • Delivery timelines for edited photos, albums, and other deliverables will be communicated per project. Delays caused by client-side factors (e.g., late approvals or incomplete information) are not the responsibility of PixAlt.
  • Reshoots, additional edits, or scope changes beyond the agreed deliverables may incur additional charges.

5. Payments

  • All fees are quoted in Indian Rupees (₹) and are exclusive of applicable taxes unless stated otherwise.
  • Payments may be made through the payment methods we make available. You agree to provide accurate billing information.
  • We reserve the right to suspend access or pause services for accounts with overdue or failed payments.

6. Intellectual Property & Usage Rights

  • The PixAlt name, logo, software, and website design are the property of PixAlt and may not be copied or reused without written permission.
  • Content you upload remains yours. By uploading it, you grant PixAlt a limited licence to host, process, and display it solely to provide the Services.
  • For commissioned photography and design work, usage and ownership rights are as defined in your project agreement. Unless otherwise agreed, PixAlt may display delivered work in its portfolio and marketing.

7. Acceptable Use

You agree not to use the Platform or Services to:

  • Upload or share unlawful, infringing, defamatory, or offensive content;
  • Attempt to gain unauthorised access to our systems or interfere with their operation;
  • Resell, sublicense, or reverse-engineer the software without our written consent;
  • Violate any applicable law, including the Information Technology Act, 2000.

8. Service Availability

We aim to keep the Platform available at all times but do not guarantee uninterrupted access. Maintenance, updates, or factors beyond our control may cause temporary downtime. We are not liable for losses arising from such interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, PixAlt's total liability for any claim arising from your use of the Platform or Services shall not exceed the amount you paid to us in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including loss of data, profit, or business.

10. Termination

We may suspend or terminate your access if you breach these Terms, fail to pay, or misuse the Platform. Upon termination, your right to use the Services ends, though provisions relating to intellectual property, liability, and governing law survive.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the website or by email. The "Last updated" date above reflects the latest revision.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Trichy (Tiruchirappalli), Tamil Nadu.
